1. Scope and Provider

These Terms of Use apply to the use of the WARdrop. mobile application (“App”) and the related services (together the “Service”). Your contract partner is Sean G. O., Alte Poststraße, 53913 Swisttal, Germany (“we”, “us”). You will find further contact details in the Legal Notice.

The Service is intended for private use by consumers within the meaning of § 13 of the German Civil Code (BGB). Conflicting terms of yours do not apply unless we expressly agree to them.

2. Our Services

WARdrop. is an application for iOS devices for managing your wardrobe digitally. It includes:

  • Cataloguing clothing items from photos, with automatic background removal
  • Sorting items into tops, bottoms, footwear, outerwear, dresses and accessories
  • Creating, combining, saving and scheduling outfits, with optional reminders
  • Weather-based outfit suggestions (requires the location permission or the entry of a city)
  • Colour analysis of your items and a Smart Shopping Assistant that compares a photographed garment against your wardrobe
  • Collections, favourites, search and milestones
  • Showing parts of your wardrobe to other members for a limited time, at your invitation, including saving a copy and suggesting outfits (Section 5)
  • An editorial Inspiration Feed
  • Home Screen widgets and a share extension for adding photos from other apps
  • An optional Sell item shortcut that saves a photo to your Photo Library and opens a third-party marketplace

Part of the Service is free. Some features are reserved for paid subscriptions (Section 8). Weather data and suggestions are aids for your own decision; the weather data comes from third parties (see the Privacy Policy).

Further development

We keep developing the Service and may change, add or discontinue features where there is a valid reason (for example technical development, new legal requirements or the prevention of abuse) and the change is reasonable for you. This causes you no additional costs. If a change affects your use more than insignificantly, we will inform you clearly and comprehensibly, and you may terminate the contract free of charge within 30 days of the information or, if it comes later, of the change (§ 327r BGB).

3. Account and Minimum Age

Registration

You need an account for most features. You can create one with an email address and password, or with Apple or Google. Your registration creates a usage contract for the free Service to which these terms apply. You can open, save and print these terms at any time on wardrop-app.de; we do not store the contract text separately for you.

Information and credentials

You give correct information when you register and keep it up to date. You keep your credentials secret. If you notice that somebody uses your account without authorisation, please tell us immediately at wardropapp@gmail.com. You are responsible for actions under your account to the extent you are accountable for them.

Minimum age

You must be at least 16 years old to use WARdrop. If you are not yet 18, use paid subscriptions only with the consent of your legal guardians.

Confirming your email address

If you register with an email address and password, you must confirm the address within 30 days. We remind you in the App and by notification. If you do not confirm it, we delete the account with all its content (details are in the Privacy Policy, Section 4). While you have a paid plan, the period is paused. Accounts created with Apple or Google are not affected.

4. Your Content

Your rights

All rights in the photos, outfits and other content you create in the App (“User Content”) remain with you.

What we may do with it

So that we can provide the Service, you grant us a simple, non-transferable right, limited to the duration of your use, to store your User Content, to process it technically (for example to remove the background and detect colours), to display it to you and to transmit it to people to whom you give access. For no other purpose: we do not use your content for advertising, we do not share it with third parties and we do not publish it anywhere without asking you first. Showing another member part of your wardrobe (Section 5) does not widen this right.

Being featured

If you switch on Open to Being Featured in Settings, we may contact you about appearing in our Inspiration Feed. The setting is off unless you switch it on, and switching it on is only an invitation to be asked. If you decide to take part, we settle with you beforehand exactly which photos and words are used and how you are credited. You keep ownership of everything you contribute and may ask us to take a feature down at any time.

Your responsibility

You are responsible for the content you upload. You make sure that:

  • you have the rights to the photos and content you upload
  • your content does not infringe the rights of third parties and does not violate any laws
  • your content contains nothing unlawful, offensive or harmful
  • you have the consent of the people who are recognisable in your photos

We do not review User Content in advance. If a third party makes a claim against us because of unlawful content you uploaded, you release us from justified claims as between you and us, to the extent you are accountable for the violation.

5. Sharing With Other Members

You may invite another member to view part of your wardrobe for a limited time. This section applies to both sides, and by using the feature in either direction you accept it.

If you are sharing

You decide who may look, which part they may look at and for how long — 15 minutes, 30 minutes or one hour — and you may end their access at any moment. Your collections and your favourites are separate permissions and are always asked for and answered separately. You can also allow the person to suggest outfits to you from your collections; whether you save a suggestion is up to you.

You are responsible for who you invite. Sharing begins with a link you send to somebody yourself, so anyone who can ask is somebody you have chosen to give that link to. Replace it in the App if it goes somewhere you did not intend.

Understand what you are agreeing to. Somebody you allow can save a copy of any item they can see into their own wardrobe, and that copy is theirs to keep. They can also photograph or screenshot their own screen, which no application can prevent.

Ending access stops them seeing anything further. It does not delete copies already saved, and it cannot recall what they have already seen. Share only with people you trust.

If you are viewing

What you are shown remains the other member’s property and was shown to you to look at. Beyond looking, the App lets you save a copy and, where you were allowed to, suggest outfits. Everything else is off limits.

Saving an item

You may use Save to my closet to keep a copy of an item you have been shown. The copy becomes part of your own wardrobe and remains after access has ended or expired. The owner is told: saving triggers a notification naming you and the item.

Because the copy outlasts the permission that produced it, it is a picture of somebody else’s belongings, kept with their knowledge that this is possible but without their approval of any particular copy. If you do not delete it when reasonably asked to, you breach these Terms.

What you may not do

  • Screenshot, record or otherwise reproduce another member’s wardrobe content outside the App’s own save feature
  • Re-share, publish or show that content to anyone else, saved or not
  • Use it to build any record, list or catalogue of another person’s belongings
  • Use it to impersonate, harass, pressure, embarrass or profile another person
  • Use it for any commercial purpose, including valuation, resale or advertising
  • Attempt to retain, restore or extend access after it has ended, or to work around the time limits or permissions

Permission to view is given to you by another person, not by us. It may be withdrawn at any time, and it expires on its own regardless.

Our role

We provide the mechanism and enforce the limits it advertises. We do not review what members show one another and are not a party to any agreement between them. What somebody does with something they were shown is a matter between the two members. Misuse of this feature does breach these Terms, however: report it to wardropapp@gmail.com; we may then act under Section 11.

6. Rules of Use

You use WARdrop. lawfully and in line with these Terms. In particular, you refrain from:

  • using the App for unlawful purposes
  • attempting to gain unauthorised access to the App or related systems, or to disturb their integrity or performance
  • uploading malicious code or harmful content
  • using automated tools, bots or scrapers to access the Service
  • attempting to view another member’s wardrobe without their valid permission, and circumventing or extending the time limits or scope of an access
  • publishing your share link publicly, and passing on a link that was given to you
  • reproducing, selling or otherwise exploiting parts of the App without our permission

In case of a violation we may, under Section 11, remove content, suspend an account or terminate the contract.

7. Rights in the App

The App, its design, features, graphics and all content provided by us (excluding User Content) are protected by copyright and other rights. The name WARdrop. and the logo are our marks.

You receive a simple, non-transferable right to use the App on your own devices for private purposes. No further rights are granted to you. Mandatory statutory permissions, for example under §§ 69d and 69e of the German Copyright Act (UrhG), remain unaffected.

8. Paid Subscriptions

Plans

Some features are reserved for paid subscription plans. The App shows you which plans exist, what they include, what they cost and for which term, before you buy.

Handled by Apple

Purchase, payment, renewal and cancellation run through your Apple ID in the App Store; Apple’s terms apply in addition. We do not receive your payment details. Price changes to an existing subscription take effect only with your consent, which you give to Apple.

Renewal and cancellation

A subscription renews automatically for the booked term unless you cancel at least 24 hours before the end of the current term. You can cancel at any time, effective at the end of the current term, in your Apple ID settings under “Subscriptions”. Until then you can keep using the paid plan.

When a subscription ends

You can then keep using the free features. If your content exceeds the limits of the free plan, we set the surplus items aside and remove them permanently after 30 days. If you allow notifications, we remind you the day before. If you subscribe again within that period, you get them back as far as the plan has room for them. Please back up content you want to keep in good time.

Right of withdrawal

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Sean G. O., Alte Poststraße, 53913 Swisttal, email: wardropapp@gmail.com) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments we have received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw. For this reimbursement we use the same means of payment you used for the original transaction; the refund is made through Apple. If you requested that the service begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry. The right of withdrawal expires for a contract for the provision of services once we have fully provided the service and performance began only after you gave your express consent and acknowledged that you lose your right of withdrawal once the contract has been fully performed by us.

Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.)

To Sean G. O., Alte Poststraße, 53913 Swisttal, email: wardropapp@gmail.com:
I hereby give notice that I withdraw from my contract for the provision of the following service: WARdrop. subscription (plan: ______)
Ordered on (*) ______ / received on (*) ______
Name of consumer ______
Address of consumer ______
Date ______
(*) Delete as appropriate.

9. Availability, Defects, Updates

We aim for trouble-free operation. Maintenance, technical faults and outages at third parties (for example Apple, the hosting or your network provider) may restrict availability from time to time. There is no right to uninterrupted availability of the free Service.

If the Service does not meet the contractual requirements, you have the statutory rights for defects of digital products under §§ 327 et seq. BGB. They remain unaffected. Please report defects to wardropapp@gmail.com.

We provide you with the updates required to keep the Service in conformity (§ 327f BGB) and inform you about them. You install updates through the App Store; your device must have the iOS version the update requires.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, for fraudulently concealed defects and where we have given a guarantee.

In cases of slight negligence we are liable only for the breach of an essential contractual obligation, that is, an obligation whose fulfilment makes the contract possible in the first place and on whose observance you may regularly rely, and then only for the foreseeable damage typical for this kind of contract. Otherwise liability for slight negligence is excluded.

For loss of data we are liable in cases of slight negligence only for the effort that would have arisen had the data been backed up properly and regularly.

These provisions also apply for the benefit of our employees and agents. Statutory claims that cannot be limited remain unaffected.

11. Term, Termination, Suspension

The usage contract for the free Service runs for an indefinite period. You can end it at any time without notice by deleting your account in the App settings. You cancel a subscription as described in Section 8.

We may terminate the usage contract for the free Service with four weeks’ notice in text form, for example if we discontinue the Service. The right of both sides to terminate for good cause (§ 314 BGB) remains unaffected. Good cause exists in particular in case of a serious or repeated breach of Section 5 or 6.

Instead of terminating, we may, in case of a violation, remove content or suspend the account temporarily if that is proportionate. We will then inform you, stating the reasons, and give you an opportunity to respond, unless that is not possible for security or legal reasons.

When the contract ends, your right of use ends. We delete your data as described in the Privacy Policy.

12. Changes to These Terms

We may change these Terms with effect for the future where there is a valid reason, for example a change in law, a change in case law, technical development or the prevention of abuse, and the change is reasonable for you. We inform you at least four weeks in advance in the App or by email.

Changes that would materially alter the relationship between performance and consideration to your disadvantage take effect only with your express consent. If you do not agree, the previous terms continue to apply; we may then terminate the contract under Section 11.

13. Governing Law, Jurisdiction, Language

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another state, you keep the mandatory consumer protection provisions of that state.

If you are a merchant, a legal entity under public law or a special fund under public law, our seat is the place of jurisdiction. For consumers the statutory places of jurisdiction apply.

The contract language is German. This English version is a convenience translation only; in case of discrepancies the German version prevails.

Whether we take part in proceedings before a consumer arbitration body is stated in the Legal Notice.

Should a provision of these Terms be invalid, the rest of the contract remains valid. The statutory provision replaces the invalid one (§ 306 BGB).
